Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before scheduling an appointment and acccessing the VRT Consulting website operated by VRT Consulting LLC ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
The contents of this website, made available through webhost "Squarespace," such as text, graphics, images, and other material contained on the website ("Content") are for informational purposes only and do not constitute medical advice.
The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Purchases & Cancellation Policy
If you wish to purchase any service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, basic contact information, email, and credit card information.
Cancellations are accepted up to 24 hours in advance of a scheduled appointment through the Acuity scheduling system. Clients will then ask to reschedule their appointment, as refunds cannot be processed at this time.
The Consultant agrees that it shall provide its expertise to the Client for all things pertaining to Vision Rehabilitation Therapy (the “Consulting Services”).
Intellectual Property Rights in Work Product
The Parties acknowledge and agree that the Client will hold all intellectual property rights in any work product resulting from the Consulting Services including, but not limited to, copyright and trademark rights. The Consultant agrees not to claim any such ownership in such work product’s intellectual property at any time prior to or after the completion and delivery of such work product to the Client.
The Consultant shall not disclose to any third party any details regarding the Client’s business, including, without limitation any information regarding any of the Client’s customer information, business plans, or price points (the “Confidential Information”), (ii) make copies of any Confidential Information or any content based on the concepts contained within the Confidential Information for personal use or for distribution unless requested to do so by the Client, or (iii) use Confidential Information other than solely for the benefit of the Client.
During the term of this Agreement the Consultant shall not engage, directly or indirectly, as an employee, officer, manager, partner, manager, consultant, agent, owner or in any other capacity, in any competition with the Client or any of its subsidiaries, including any company engaged in Vision Rehabilitation Therapy services outside the State of New York.
During the term of this Agreement the Consultant shall not engage in soliciting Clients living in the State of New York as a self-initiated noncompete agreement.
The Client agrees to indemnify, defend, and protect the Consultant from and against all lawsuits and costs of every kind pertaining to the Client’s safety and independence including reasonable legal fees due to any act or failure to act by the Client based upon the Consulting Services.
This Consulting Agreement and the interpretation of its terms shall be governed by and construed in accordance with the laws of the State of New York and subject to the exclusive jurisdiction of the federal and state courts located in Queens, New York.
Vision Rehabilitation Therapy: Release of Liability
Vision Rehabilitation Therapy is a service that provides consultation to individuals with vision loss. The client is aware that telerehabilitation, or remote videoconferencing is in no way to be construed or substituted as recommended in-person therapy, or any other type of medical advice. No assumption of responsibility is made, or given, and the client requesting such advice agrees not to hold the Consultant responsible or liable in any form or fashion, for such actions taken of their own accord. The method and process by which this advice and direction are given in no manner whatsoever, written or verbal, constitutes an agreement or liability on the part of the provider and is acknowledged to be different in many ways than clinical and medical counseling.
The client agrees that using Vision Rehabilitation Therapy consultation services are entirely at their own risk. Consulting services are provided "as is", without warranty of any kind, either expressed or implied, including without limitation any warranty for information services, coaching, uninterrupted access, or products and services provided through or in connection with the service. This service is requested at the client's own choice and with inherent singular responsibility. Any actions or lack of actions, taken by the client of such advice is done so solely by choice and responsibility of the client and is neither the responsibility nor liability of the Consultant.
The client takes full responsibility in the decisions they make after receiving remote telerehabilitation services, as well as the consequences. The client enters into consultation with full understanding that they are responsible for creating their own results. Periodically the Consultant may provide links to other web sites or written print material which may be of value, interest and convenience to you. This does not constitute endorsement of material at those sites or any associated organization product of service. It is the responsibility of the user to make their own informed decision about the accuracy of the information at those sites and print material including their privacy policies. In no event shall the Consultant be liable for any incident or consequential damages resulting from use of the material.
